On December 16, YouTuber Tenchimu, 31, was ordered by the Tokyo District Court to pay damages of approximately 380 million yen in a ‘night bra lawsuit’.
She lost the case and owes a total of 500 million yen for the disturbances. She had previously announced her intention to appeal, but the district court had been arguing the case for two weeks and it would be difficult to overturn the decision.
Tenchimu produced a night bra that she said would create ideal breasts just by wearing it, and the manufacturer advertised the product extensively, resulting in a huge hit. However, it came to light that she had actually undergone breast implant surgery, and she and the manufacturer were called for refunds by the purchasers.
According to her YouTube video, she sent a total of 220 million yen to the manufacturer on multiple occasions in order to give refunds herself. However, she didn’t know whether the company used the money to refund the purchasers, and in2021 she filed a lawsuit in the Tokyo District Court demanding disclosure of the use of the money. The company then counter-claimed that it had breached its duty of explanation by concealing the breast surgery.
She said in a video that she was prepared for the sentence to be harsh and that she was willing to go bankrupt if she had to pay a huge amount of compensation.
The ruling by the Tokyo District Court on December 16 is below.
The plaintiff, Tenchimu shall pay the defendant (the manufacturer) JPY 384,574,504, plus 3% per annum from October 18 2022 until paid.
Both Tenchimu and the manufacturer were absent from the sentencing.
According to a YouTube video, she earned 100 million yen for producing the night bra, and the manufacturer sold 3.7 billion yen. She had an income of 100 million yen, but she spent 220 million yen in refunds to buyers and was ordered to pay 380 million yen in judgment, which means she owes a total of 500 million yen in expenditure for a series of troubles.
